Jefferson City, Mo. – The state appeals court in Kansas City will hear the dispute over when Missourians should vote on a proposed state constitutional ban on gay marriage.
Governor Holden told Secretary of State Matt Blunt yesterday to schedule the election for the August primary.
Blunt balked. And state Attorney General Jay Nixon sued Blunt.
Earlier Friday, a judge in Jefferson City ruled in Blunt's favor.
Nixon appealed directly to the state Supreme Court.
But now the high court says the case needs to go first to the court of appeals.
Nixon transfered it to the appeals court in Kansas City, which plans a hearing on Monday morning.
